Marthinus Pelser in court today

The 22-year-old man accused of murdering his six-month old son, Deon will appear again today (10 October) in the Roodepoort Magistrate Court.

Marthinus Pelser is on trial for murder of his son, after the baby was found dead, with a fractured skull and multiple burn wounds, in his cot on 11 June. The baby’s mother came home after work and found Pelser exiting the bathroom with a knife.

When the mother went to see her baby, Pelser fled the scene with the couple’s copper Kia Picanto. Pelser was arrested on 15 June on Christiaan de Wet Road when his car ran out of petrol. A woman spotted him at the Sasol garage on the same road and informed the Honeydew Police.

Pelser appeared in court for the first time on 17 June without a legal representative, but since then has received the help of legal aid. Pelser signed divorce papers on 22 June. The mother has not been in court as yet.

On 9 September people the court was read evidence from the investigating officer’s affidavit. According to the investigating officer, a notebook was found in the couple’s kitchen with an Afrikaans note, allegedly written by Pelser. It translated into Pelser saying sorry and that he is seeking his wife’s forgiveness. He also asked her to phone the police. It went further where Pelser said that his wife should know that he will always love her.


A second note read that he was in the field next to the complex and that police should be sent. On 16 September the court heard through the baby’s mother’s affidavit that she had been abused by Pelser before and that she wanted to divorce him, but he threatened to kill her.

Pelser will hopefully hear if his bail application has been successful when he appears in court today. His legal representative argued that Pelser will not be in danger as he will stay in Swart Ruggens with a relative. He also argued that this is not a scheduled 5 offense as Pelser has no previous convictions.

The community has showed their support by attending court cases in white shirts. A Facebook page, ‘Justice for baby Deon’ and a petition against the awarding of bail were also started. Family of Pelser is expected to be present in court again today.
